4-1-2: CHIEF OF POLICE 1 :
   A.   Appointment And Eligibility: The chief of police 2 shall be appointed by the mayor, with the advice and consent of the city council, as provided by law. The chief of police shall be subject to the same resident requirements as apply from time to time to all other city police officers. (Ord. 95-35-0, 9-13-1995)
   B.   Powers And Duties: The chief of police shall have and perform the following powers and duties:
      1.   Property Custodian: He shall have custody and control of the offices, jail, equipment, books, records and other property of the police department. (1970 Code §3-1-2.2)
      2.   Preservation Of Peace: He shall preserve the peace and secure good order and cleanliness within the city, and to that end he shall enforce all laws and city ordinances, and orders of the mayor and city council. He shall cooperate with other city officials, especially with the health and fire departments, and when a violation of the law is brought to his attention, he shall take the proper action in the matter. (1970 Code §3-1-2.3)
      3.   Control Of Department: He shall issue general orders requisite to the conduct of the affairs to the department, and all members shall be subject to said orders. (1970 Code §3-1-2.4)
      4.   Rules And Regulations: He shall recommend changes in the rules and regulations for the police department from time to time as he shall deem proper and necessary. Such rules and regulations may provide for reasonable and proper disciplinary measures and penalties for any neglect of duty or misconduct on the part of any member of the department. The chief shall furnish a copy of the rules and regulations so prescribed for the government of the department. (1970 Code §3-1-2.5)
      5.   Emergency Plan: He shall maintain, on a military basis, an emergency organization plan for the entire police force capable of effecting immediate and concerted action in case of riots, catastrophes, disasters and other emergencies. (1970 Code §3-1-2.6)
      6.   Annual Reports and Budget Requirements: He shall, at the first meeting of the City Council in May of each year, make an annual report in writing to the Mayor and City Council of the state of the police force, with a detailed report of the transactions of the Police Department for the preceding year, with such statistics and suggestions in regard to the requirements of said Department as he may deem advisable; and he shall also make reports of any matter or thing concerning such Department, whenever requested by the Mayor or City Council. (1970 Code §3-1-2.7)
      7.   Instructions: He shall be responsible for instructing members of the Department in police work. (1970 Code §3-1-2.8)
      8.   Disciplinary Power: He shall have full power and authority to reprimand or suspend, without pay, any Department member for disciplinary purposes, for a period of time not to exceed five (5) days in length. The Board of Fire and Police Commissioners 3 and the person suspended, if he desires, may request a hearing before said Board of Fire and Police Commissioners. Request shall be in writing within twenty four (24) hours of written notice of suspension. Three (3) copies of the request, giving full details, shall be submitted and the Board shall set a hearing date within thirty (30) days after receiving such request. (1970 Code §3-1-2.9)
      9.   Discharge of Probationers: Probationers in the Police Department may be recommended for discharge by the Chief of Police, subject to the approval of the Board of Fire and Police Commissioners, at any time during their probationary period, which shall be one year from the date of appointment. The Chief shall make monthly reports on probationers to the Board of Fire and Police Commissioners. (1970 Code §3-1-2.10)
      10.   Keeping Records:
         a.   Register of Members: He shall keep a register of all members of the Police Department, with complete information as to the date of birth, nativity, former occupation, dates of appointment and promotion, commendations, reprimands, suspensions, reinstatements, resignations and death; also other data as may be required. (1970 Code §3-1-2.11)
         b.   Inventory of Property: He shall be responsible for maintaining an inventory of all station furniture, equipment and supplies in the Police Department. (1970 Code §3-1-2.12)
         c.   Absentee Record: Time allowed and lost by members of the Police Department shall be placed in a file of members' names arranged in order, on the form prescribed herein by the Chief of Police. This report is to be filled out in all cases of absenteeism regardless of cause. The report shall be made out in duplicate and sent to the Chief, who shall sign and forward one copy to the secretary of the Board of Fire and Police Commissioners as soon as possible. If injury or illness is caused in the line of duty, the commanding officer of the officer involved shall also sign the report. If disability prevents absentee from making this report, then the Chief of Police shall see that this report is forwarded. (1970 Code §3-1-2.13)
         d.   Efficiency: Efficiency records of members of the Police Department shall be kept under the supervision of the Chief. He shall make a written evaluation of the efficient performance of each member of the Police Department every four (4) months, and a copy shall be sent to the Board of Fire and Police Commissioners.
All acts of commendation shall also be reported in writing to the Board of Fire and Police Commissioners and shall remain a part of their permanent record for future reference in promotional examinations, etc. (1970 Code §3-1-2.14)
      11.   Issue Orders and Assign Duties: He shall:
         a.   Have control of all police communications. Orders to the Police Department shall be issued by him through the commanding officer or in such manner as circumstances may require.
         b.   Have power to promulgate general orders to the Police Department not inconsistent with the laws and ordinances, or the Rules and Regulations; such orders shall be written or printed, and all members of the Department shall obey them.
         c.   Be invested with the power to post the policemen under his command in such parts of the City and assign them such duties as he may deem expedient. It shall be his duty to keep a register of the Police Department wherein shall be kept the name of every member of the Police Department, the duty to which he may be assigned, his beat and whether for regular or special duty, and such entry shall be made from day to day during each month, and in such register sufficient space shall be left against all such entries wherein to make a record of the arrests made by such members of the Department.       12.   Youth Officers: He is hereby authorized to designate any member of the Department as a youth officer, who shall have charge of all juvenile offenders or juveniles charged with an offense. (1970 Code §3-1-2.16)
      13.   Corporals: He is hereby authorized to designate any patrolman a Corporal, and to remove any patrolman from that position, all in accordance with the procedure set forth in Section 4-1-6C of this Chapter. (Ord. 87-42-0, 7-22-87)
