3-4-8-2: STATUTES AND CODES:
In order to effectuate the intent hereof, section 5/1-3-1 et seq., of the Illinois municipal code 1 , as amended; the 1998 and all subsequent editions of, or amendments to, the Illinois department of public health's publication currently titled, "Food Service Sanitation Code", that are on file with the secretary of state; and the 1992 and all subsequent editions of, or amendments to, the Illinois department of public health's publication currently titled, "Retail Food Store Sanitation Code", that are on file with the secretary of state, are incorporated in and made a part hereof by reference.
The issuance of licenses shall be governed by sections 3-4-1-3, "Application For License"; 3-4-2-1, "Food Delivery Vehicles"; 3-4-2-2, "Food Dispensing Vehicles"; 3-4-3, "Ice Cream Parlors"; 3-4-4, "Milk Dealers"; 3-4-5, "Refrigeration Locker Plants"; 3-4-6, "Restaurants"; 3-4-6-7, "Drive-In/Carryout Restaurants"; 3-4-7, "Vending Machines" of this chapter; suspension and revocation of licenses to operate retail food establishments; the prohibiting of the sale of unsound or mislabeled food or drink; and the enforcement of this chapter shall be regulated in accordance with this section 3-4-8. The inspection of food service establishments shall be regulated in accordance with the 1998 and all subsequent editions of, or amendments to, the Illinois department of public health's publication currently titled, "Food Service Sanitation Code" that are on file with the secretary of state. The inspection of retail food stores shall be regulated in accordance with the 1992 and all subsequent editions of, or amendments to, the Illinois department of public health's publication currently titled, "Retail Food Store Sanitation Code", that are on file with the secretary of state.
Further, three (3) copies of each of the Illinois department of public health's publications currently titled, "Food Service Sanitation Code", and "Retail Food Store Sanitation Code", shall be on file at the city clerk's office and available to public inspection during normal business hours.
