8-2-2: RATES AND CHARGES:
All water furnished or delivered by the city through its city water system shall be delivered and measured through city owned meters, installed at or near the property line of the consumer's or owner's premises, under the following conditions and subject to the following schedule of rates and charges: (Ord. 490, 9-11-2012)
   A.   Deposit Requirements; Disconnection Of Service; Reconnection Fee: As a condition of receiving city water service, each applicant for service shall deposit with the city clerk-treasurer a sum as established by resolution of the city council to be retained by the city. Upon termination of service or twelve (12) months after such deposit is paid and if the applicant has not, during such period, ever been delinquent in the monthly payments due under this section, such deposit shall be refunded to the applicant. Upon any default in payment of water service charges, such deposit may be applied to the applicant's account. Any default in payment of more than two (2) months will cause the service to be disconnected with a charge as established by resolution of the city council for reconnection of service.
   B.   User Rates:
      1.   Established: A minimum charge as established by resolution of the city council per calendar month shall be made for each noncommercial, single occupancy metered user, which base charge shall be in payment of the first one thousand (1,000) cubic feet of water consumed and no less rate than such minimum charge shall be fixed or charged; provided further, that the base charge shall be separated into categories of use called classes with the base category (class) being the equivalent user. Each of the classes will then be compared to the base class on the basis of water usage and a numerical value assigned representing the ratio of the categorized class to the base class. User charges are to be calculated for the appropriate class with the numeric values multiplied by the equivalent user charge as shown in the following: (Ord. 490, 9-11-2012; amd. Ord. 500, 9-10-2013)

      2.   Calculation Of Rate: A rate table shall be established to be used for billing purposes. Each rate shall be calculated by multiplying the numeric value assigned to the user class and the charge amount established for an equivalent user. Said rate table shall be reviewed annually and adjusted as necessary. (Ord. 490, 9-11-2012)
      3.   Use In Excess Of One Thousand Cubic Feet: For all water delivered in excess of one thousand (1,000) cubic feet, charges shall be established by resolution of the city council. (Ord. 490, 9-11-2012; amd. Ord. 500, 9-10-2013)
   C.   Discontinuance Of Service; Reconnection Fee:
      1.   A fee as established by resolution of the city council shall be charged for any reconnection of water service after discontinuance for any reason with the exception of a shutoff to replace or repair lines. (Ord. 263, 5-9-1989; amd. Ord. 500, 9-10-2013)
      2.   Before any discontinuance of water service for any reason other than to replace or repair line, the owner or person in charge of the metered premises shall request in writing the shutoff and contract to pay a turn on fee for this discontinuance as established by resolution of the city council.    D.   Request For Additional Service; Payment Of Current Fees Required: Any water user requesting service at another location, either as an added service or to move the service, shall pay any fees due before the service can commence. (Ord. 429, 5-22-2007)
   E.   Payment Due Date; Delinquencies: All accounts or charges for the use of city water shall be due and payable on or before the fifteenth day of the month following the month of use, and if not so paid, a penalty of ten percent (10%) shall be charged and collected. Delivery of water to any delinquent consumer shall be discontinued and water turned off when the account is delinquent more than sixty (60) days. The water shall not be turned on and service resumed until such delinquent consumer has first paid the city clerk-treasurer a reconnection fee as established by resolution of the city council and all sums, with penalty, then owing on any such account.    F.   Violation; Penalty: Any violation of this section shall be a misdemeanor punishable in accordance with the statutes of the state of Idaho. (Ord. 490, 9-11-2012)
