5-5-2: TOBACCO SALES AND USE:
   A.   Providing To, Permitting Use Prohibited:
      1.   It shall be unlawful for any person, firm or corporation within the corporate limits of the city to either give, sell, barter or exchange any tobacco, cigar or cigarette, or any substance or compound of which tobacco, in any form, constitutes a component part, to any person under the age of eighteen (18) years, or to suffer or permit any such person to smoke, chew or otherwise use any tobacco, cigar or cigarette in and around any building or premises owned or controlled by any such person, firm or corporation.
      2.   Any person violating this subsection A shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punishable as provided in section 1-4-1 of this code.
   B.   Use Prohibited:
      1.   It shall be unlawful for any person under the age of eighteen (18) years, upon any street or alley or within any building or other place within the corporate limits of the city, to either chew or smoke tobacco in any form whatever.
      2.   Any person violating this subsection B shall be deemed guilty of an infraction and, upon conviction thereof, shall be fined as provided in section 1-4-1 of this code. (Ord. 29, 2-5-1906; amd. 2015 Code)
