11-4-2: PLANS; GUARANTEE OF IMPROVEMENTS:
   A.   Filing Plans:
      1.   At the time of filing of the final plat, the subdivider shall file with the public works supervisor construction drawings for all improvements required in the subdivision. (Ord. 228, 12-15-1981; amd. 2015 Code)
      2.   Plans for the improvements herein required shall be prepared by a professional engineer registered in the state of Idaho.
   B.   Guarantee Of Improvements:
      1.   Surety Bond Or Other Guarantee: At the time of filing the final plat, the subdivider shall file with the city clerk- treasurer a surety bond or other guarantee acceptable to the council to secure to the city the actual construction of such improvements, according to specifications, within a period of time not to exceed one year from the date of approval of the final plat; provided, however, that the council may extend the allowed period of construction for one year upon the showing of just cause by the subdivider. Such bond or other guarantee shall be in the amount of one hundred ten percent (110%) of the estimated cost of the improvement as determined by the council.
      2.   Letter Of Credit:
         a.   The only other guarantee (other than a surety bond) will be an irrevocable letter of credit from an acceptable bank, licensed to do business in the state of Idaho. Said letter of credit shall be in an amount equal to one hundred ten percent (110%) of the estimated cost of construction of the development for the entire subdivision. The letter of credit shall name the city of Council, Idaho, as administrator of the account with access to use of the funds for completion of the development work in the event that the developer fails in his obligation to complete the work within the time frame agreed to upon acceptance of the final plat. Costs of completing any unfinished work may include all administrative, material or incidental costs incurred by the city in its pursuit of completion of the work.
         b.   Said letter of credit shall state that the city shall be held harmless from all causes in completing the work and shall in no way be liable for payment of costs of any kind or for repayment of any loans connected with the letter of credit for the project. (Ord. 228, 12-15-1981)
   C.   As Built Plans: Prior to the acceptance by the city of any improvement installed by the developer, two (2) sets of prints of the as built plans and specifications for all improvements, one set of which shall be certified and signed by the engineer preparing such plans, shall be filed with the public works supervisor, and the second set shall be filed with the Idaho department of environmental quality by the developer. In addition to the prints, an electronic copy compatible with city systems shall be filed with the city. (Ord. 228, 12-15-1981; amd. 2015 Code)
   D.   Certificate Of Completion; Release Of Guarantee: Within ten (10) days after the completion of improvements, the completion of which is guaranteed by a surety bond or other guarantee as provided in subsection B of this section and the filing of the "as built" plans as provided in subsection C of this section, the city engineer shall certify in writing the completion and acceptance of said improvements and shall transmit a copy of such certification to both the city clerk- treasurer and the subdivider. The city shall thereafter release said surety bond or other guarantee upon application by the subdivider. (Ord. 228, 12-15-1981)
