9-5-8-14: EXCEPTIONS:
   A.   Authority To Approve; Conditions: The planning and zoning commission may approve an exception to any portion of the standards of design or required improvements set forth herein where the applicant can show that:
      1.   Because of topographical or other conditions peculiar to the site, a departure may be made without destroying the intent of such provisions; and
      2.   The granting of the exception will not be detrimental to the public welfare nor injurious to other property in the vicinity in which the mobile home park is situated.
   B.   Application For Exception: Application for any such exception shall be made by a petition of the applicant, stating fully the grounds for the request. Such petition shall be filed with the application for approval.
   C.   Findings Of Fact: The reasons for granting any exception shall be stated in writing in the minutes of the planning and zoning commission.
   D.   Decision Of Planning And Zoning Commission; Appeals: The decision of the planning and zoning commission on exceptions to the provisions of this chapter shall be considered final unless further appealed to the city council by either the petitioner, a representative of the city or any other interested person. In the event that an appeal is not taken from such decision of the planning and zoning commission within fifteen (15) days thereof, such decision shall then be conclusive, and there shall be no further right to appeal such decision to the city council. An appeal shall be filed in writing with the building inspector. The appellant will be notified by the building inspector of the date scheduled for the hearing of the appeal by the city council.
