§ 36.05 PARKS AND RECREATION BOARD.
   (A)   Creation. There is hereby created a Parks and Recreation Board for the city consisting of five (5) members who shall be residents of the city. The Board shall be appointed by the Mayor with approval of the City Council.
   (B)   Terms of members. All appointments to the Board shall be for terms of four (4) years and until their successors are appointed, except that the members first appointed shall be on (1) for one (1) year, one (1) for two (2) years, one (1) for three (3) years, and two (2) to four (4) years. Members may be reappointed for consecutive four (4) year terms. Vacancies shall be filled in the same manner as original appointments and for the unexpired term.
   (C)   Designation and term of Chairperson and Vice-Chairperson. The Board shall elect from its membership a Chairperson, Vice-Chairperson and a Secretary/Treasurer. Such election shall occur at the first meeting of the Board and annually at the first meeting of each year thereafter.
   (D)   Compensation. The members of the Board shall serve without compensation.
   (E)   Meetings; quorum. The Board shall hold public meetings at least monthly. A majority of the Board shall constitute a quorum for the transaction of business, and all actions shall require the concurring vote of a majority of the members present. All meetings shall be held in compliance with the Kentucky open meetings laws.
   (F)   Functions and powers. The function of the Board shall be to provide, conduct, and maintain parks, playgrounds, and recreation centers within the limits of the city in accordance with KRS Chapter 97.010 et seq., and may expend necessary funds for that purpose. The city may appropriate money out of the general fund of the city for his or her purpose. In addition, the Board may accept any grant or devise of real estate or any bequest or gift of money or any donation to be used for this purpose. All such funds and other property shall be under the direct control of the Board. All funds administered, supervised and controlled by the Board, whether from appropriation from the city or from levies, fees, or donations received by the Board, shall be maintained by the Secretary/Treasurer in appropriate bank accounts and deposited and expended from said accounts. All accounts of the Board and the records of the Board shall be subject to audit by a certified public accountant at the time of any by the same accountant performing an audit of the city.
   (G)   Budget and reports. The Board shall submit a budget of proposed receipts and expenditures to the City Council for its approval before April 1 of each year in order that the approved budget may, as necessary, be incorporated into the budget of the city. The Board shall, within sixty (60) days after the close of each fiscal year, furnish to the city a written statement of receipts and expenditures for the preceding year, subscribed and sworn to by the Chairperson of the Board. In addition, the Board shall, upon request of the Mayor or City Council, provide financial status reports including account balances and expenditures made during the period of time since the last such report.
   (H)   Bylaws/rules and regulations. The Board may adopt, with approval of the City Council, reasonable rules and regulations for conduct of person in the city’s parks, playgrounds and recreation centers.
