§ 91.09  FIRES; OPEN BURNING.
   (A)   Notwithstanding the provisions of G.S. § 113-60.31, as amended, whenever open burning is prohibited in the county by order or declaration of the State Department of Environment and Natural Resources; then, open burning shall be prohibited in the town.
   (B)   Any person violating the provisions of § 91.09 shall be guilty of a Class 3 misdemeanor.
