§ 804.08 THEATERS AND SHOWS.
   (a)   License required; fee; exceptions.
      (1)   No person shall exhibit any public motion picture show, theatrical or vaudeville show or other similar performance for which admission is charged, without first obtaining a license as herein provided.
      (2)   Such license shall be issued by the Chief of Police and shall be subject to a fee of fifty dollars ($50.00) per year, which may be prorated to a monthly basis, but with a minimum fee of five dollars ($5.00).
      (3)   The provisions of this section shall not be applicable to any show, performance, exhibition or entertainment exhibited or conducted by the residents of the municipality, the proceeds of which shall be devoted to any religious, educational, benevolent or charitable purpose.
   (b)   Authority of Police Chief; revocation of license.
      (1)   The Chief of Police may stop any performance and revoke any license issued under this section in case any show, exhibition or performance is conducted or exhibited in any theater or place of amusement contrary to the laws of this state or the provisions of these Codified Ordinances or any ordinance of the municipality.
      (2)   In case any such license is revoked, the unearned portion of the license fee shall be returned to the licensee.
