No person, proprietorship, partnership, corporation or other such firm engaged in the collection of garbage and trash in residential districts within the municipality, excluding the following described locations, shall engage in the collection of garbage or trash between the hours of 9:00 p.m. and 6:00 a.m. of the following day, daily.
(a) Columbiana Manor Apartments.
(b) Camelot Apartments.

(a) The Board of Directors (Board) of the Carroll-Columbiana-Harrison Joint Solid Waste Management District (District) has established and convened a solid waste management policy committee in accordance with Ohio R.C. 3734.54 (Policy Committee) to prepare a solid waste management plan for the District as required by Ohio R.C. 3734.54 (Plan).
(b) The Policy Committee completed a draft amended plan for the District and submitted that plan to the Director of the Ohio Environmental Protection agency for preliminary review and comment in accordance with Ohio R.C. 3734.54 and 3734.55.
(c) The Policy Committee received the Director’s written, non-binding advisory opinion regarding the draft amended plan and established a public comment period and held three public hearings concerning the draft amended plan.
(d) The Policy Committee, after consideration of the comments and recommendations received concerning the draft amended plan, has adopted and submitted to this legislative authority a copy of the draft amended plan for the District (the “Final Draft Amended Plan”).
(e) The final draft amended plan is hereby approved in the form submitted to this legislative authority and presently on file with the Clerk of this legislative authority.
(f) The Clerk of this legislative authority is hereby authorized and directed to mail or otherwise deliver promptly a certified copy of this resolution to the Policy Committee.

(a) The City Manager is hereby authorized to execute an agreement with the Carroll-Columbiana-Harrison Joint Solid Waste Management District, 618 B Canton Road, Carrollton, Ohio 44615 for the purpose of permitting the use of a site located at 31 West Park Avenue, Columbiana for a recycling site in accordance with the contract, as the same being a part hereof as if rewritten herein.
(b) At all times hereafter, Carroll-Columbiana-Harrison Joint Solid Waste Management District shall be deemed to be an independent contractor providing services for the City of Columbiana, and the city shall therefore assume no responsibility whatsoever for the payment of any unemployment compensation premiums, workers compensation premiums or other benefits for its agents, employees or officers; and the city shall require, that Carroll-Columbiana-Harrison Joint Solid Waste Management District shall agree to indemnify and save the city harmless from any and all injury to persons or property by reason of any acts of negligence of Carroll-Columbiana-Harrison Joint Solid Waste Management District or its agents, employees or officers.
