§ 1042.09 BOND REQUIRED.
   Any person making an installation or extension of a water main within the municipality shall, before commencing work, furnish the municipality with a surety bond or performance bond in an amount to be determined by the Engineer. Such surety or performance bond shall be made payable to the municipality for an injury to any person or property or the death of any person from any accident that is directly or indirectly resultant from such an installation or extension. Such person shall, further, by such bond, save, protect and render the municipality harmless from all damages, costs or expenses, or suits or causes of action, that may arise as a consequence of such installation or extension or the use of defective materials or workmanship. Such bond shall further stipulate that any change, deviation or violation in plans, as submitted to the Mayor and Council for approval, shall be construed as creating an immediate liability of the surety and the principal under such bond, provided, however, that an opportunity shall be given to such person to rectify such change, deviation or violation within a reasonable time set by the Manager. However, the Mayor and Council may waive these requirements at their own discretion.
