ARTICLE 7 TELECOMMUNICATIONS
TELECOMMUNICATIONS ACTIVITIES: The use, by Utilities or other telecommunications providers, of Utilities' assets for telecommunications purposes or the acquisition or enhancement of telecommunications assets and facilities necessary for Utilities' business activities. (Ord. 98-173; Ord. 01-42)
A. Utilities has an opportunity to place its assets to beneficial use by engaging in "Telecommunications Activities" as this term is defined herein.
B. Utilities has an opportunity to enhance its position as a telecommunications customer, user and provider by acquiring certain assets for use in telecommunications activities.
C. The use of Utilities' assets for telecommunications activities will not interfere with the use of the assets for other utility purposes, and will be beneficial to or used by the customers of Utilities and the citizens of the City.
D. Utilities' telecommunications activities are local in use and extent, and the systems acquired for the purposes are necessary for the citizens and owned by the citizens of the City.
E. The facilities necessary for the activities are either existing facilities or facilities to be acquired which will be part of the Utilities "System" subject to the pledge of outstanding Colorado Springs Utilities revenue bonds. (Ord. 98-173; Ord. 01-42)
