   172.01   Mandatory use of municipal water distribution system required

§ 172.01  MANDATORY USE OF MUNICIPAL WATER DISTRIBUTION SYSTEM REQUIRED.
   (A)   All buildings within the municipal boundaries of the City of Colome equipped with plumbing fixtures must utilize water from the city water distribution system and in such amounts and at such pressures as are available from the City of Colome. Only water from the municipal water system shall be utilized for use in drinking, bathing, culinary use or in the processing of food, medical or pharmaceutical products. The use of any other water source, whether supplied by wells or other non-municipal sources, for said purposes is strictly prohibited.
   (B)   All buildings outside the municipal boundaries of the City of Colome that are equipped with plumbing fixtures and that utilize water from the city water distribution system shall utilize only the municipal water source if the water is connected to the plumbing fixtures and in such amounts and at such pressures as are available from the City of Colome. The use of any other water source in said buildings, whether supplied by wells or other non-municipal sources, is strictly prohibited.

§ 172.99  PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of the basic code of ordinances.
   (B)   Any person violating any provision of § 172.01 of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine of not to exceed $200. Each day in which each violation shall continue shall be deemed a separate offense. Any prosecution hereunder shall not prevent the enforcement of any civil right or remedy hereunder or under any other applicable law. Any person violating any of the provisions of § 172.01 of this chapter shall become liable to the City of Colome of any expense, loss or damage, occasioned by reason of such violation.
