§ 93.99 PENALTY.
   (A)   Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
   (B)   Violation of § 93.01 shall be punishable by a fine of $50 for the first offense, $100 for the second offense and $200 for each offense thereafter.
   (C)   (1)   Whenever a violation of § 93.02 occurs or is alleged to have occurred, any person may file a written complaint or an oral complaint. Such complaint, stating full the causes and basis thereof, shall be filed with the city police. The city police shall properly report such complaint and immediately investigate. If the facts elicited by such investigation are sufficient to establish a reasonable belief that a violation has occurred on the part of the party investigated, the city police shall informally request the person creating the noise to correct the condition as necessary to cause the noise to abate within a reasonable period of time. If the person creating the noise does not abate the noise, or the owner of the barking dog does not quiet the dog, then the city police shall issue a citation and shall notify the City Attorney of said citation against such person requesting action thereon as provided by this penalty and in accordance with the law.
      (2)   Any person who violates § 93.02 or regulation or fails to comply with any of its requirements, shall be guilty of an infraction and upon conviction, shall be fined in the sum of $25 per incident for each violation. Any person convicted under § 93.02 a second time in a 12-month period shall be fined in the sum of $50 for the second offense. Any person convicted under § 93.02 more than two times in a 12-month period shall be fined in the sum of $100 for the third and all subsequent offenses.
   (D)   Any person violating any of the provisions of §§ 93.15 through 93.18 shall upon conviction thereof be fined in any amount not exceeding $300. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder. The procedure set forth in § 93.18 is not a condition precedent to violation and enforcement of this chapter.
