(A) All residential and commercial owners shall keep all refuse in a closed receptacle. All such receptacles shall be kept on private property.
(B) The town will provide each residential owner with one 100-gallon refuse container. All owners shall ensure that: the maximum weight of each container when full shall not exceed 50 pounds; all containers shall be kept on private property; and containers shall not be placed at the edge of the public right-of-way before sundown on the day before the scheduled day of pickup and shall be returned to private property by 7:00 p.m. on the day of pickup.
(C) The town will provide any residential owner a second 100-gallon refuse container for no additional cost to the residential owner. The residential owner will thereafter pay a monthly service charge for refuse collection for each container.
(1) The town or the town’s authorized representative, agent or contractor shall provide all commercial owners with refuse containers appropriate for the volume and/or size of the refuse generated by such owner. Monthly service charges for commercial owners shall be charged based on the number and size of the refuse containers provided and the volume of refuse collected by the town or its authorized representative, agent or contractor.
(2) No person shall use or remove refuse from any containers or from any vessel or receptacle containing the refuse of persons not receiving service from the town or its authorized representative agent or contractor in accordance with this chapter or uncover or remove refuse, without the permission or consent of the owner thereof, unless such person is actually engaged in the work of accumulating, collecting, hauling, transporting or disposing of the refuse and is permitted to do so in accordance with § 50.03.
