(A) It shall be unlawful for any person to operate, participate in, or allow the operation of a garage sale without first obtaining a garage sale permit from the city.
(B) The fee for a garage sale permit shall be as adopted by the City Council as part of the city’s fee schedule.
(C) Upon approval of a garage sale permit application, the city shall issue one permit for each garage sale; provided, however, that the individual location proposed for the garage sale has not exceeded the maximum number of garage sales allowed per calendar year.
(D) A customer or potential customer of a garage sale shall not be held liable if attending an unpermitted garage sale; provided they are not otherwise participating in the garage sale.
(E) No more than three families may combine their property for sale at a single garage sale.
(F) A garage sale permit will not be issued for a vacant lot or a lot with an unoccupied main structure.
(G) A multi-family complex with more than three dwelling units on the property shall not be eligible for individual garage sale permits. The owner/operator of an apartment complex may apply for a garage sale permit for the entire multi-family complex, but individual apartments, units, or buildings within the complex may not apply.
(H) A person renting one or more storage units at a self-storage facility shall not be eligible for individual garage sale permits. The owner/operator of a self-storage facility may apply for a garage sale permit for the entire facility, but individual units within the facility may not apply.
