(A) A representative of a private funeral escort agency, or an individual operating a private funeral escort vehicle and not employed by a private funeral escort agency, may apply for a funeral escort permit at the Cleburne Police Department by completing the standard form provided by the Chief. Such application must include the following information:
(1) The name and address of the applicant;
(2) If the applicant is a business, the trade name under which the applicant does or proposes to do business, and the name and address of each partner of a partnership or of each officer and director of a corporation, as applicable;
(3) Proof of current insurance, registration, and inspection for each private funeral escort vehicle;
(4) Proof that each private funeral escort vehicle has proper equipment as required by this chapter, and is in good condition and working order;
(5) A description of each private funeral escort vehicle, including without limitation, the type, model, and color scheme;
(6) A liability and property insurance policy and an indemnification agreement, as more specifically described in § 103.011;
(7) Affidavits from two unrelated citizens attesting to the applicant's good character; and
(8) For drivers of private funeral escort vehicles:
(a) The driver's date of birth;
(b) Address(es) and place(s) of employment for the previous two years, with the reason(s) for leaving;
(c) A photograph taken within six months prior to the date of the application;
(d) Fingerprints taken by the Cleburne Police Department;
(e) A copy of the driving record for the previous two years;
(f) If the driver has been convicted of a felony, all information regarding that conviction;
(g) A copy of a current valid driver's license; and
(9) Any other information the Chief deems necessary to determine whether the permit should be issued under the terms of this chapter.
(B) All applications for a funeral escort permit under this chapter shall be accompanied by a nonrefundable application fee of $100. An application shall not be considered to have been filed until the applicant has paid the fee in full and has submitted all required information.
(C) It shall be a violation of this chapter if a private funeral escort agency allows a driver of a private funeral escort vehicle to accompany a funeral cortege, regardless of whether the agency holds a valid permit, unless the agency has submitted to the Cleburne Police Department the information required by subsection (A)(8)(a) through (g), above, for that driver.
