§ 99.40 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   DIRECTOR OF PUBLIC WORKS. The person employed by the city as such and appointed by the City Manager.
   EXCAVATION. The making of a hole or cavity of any size in a surface, the boring or tunnelling under a surface or the disruption or breaking of a surface.
   PERSON. Any individual, firm, partnership, association, corporation, company, business entity or organization of any kind. This term shall not include the city.
   STREET. The surface of and the space above and below any public street, road, highway, freeway, lane, path, public way, ground or place, sidewalk, alley, boulevard, parkway, drive, street right-of-way or easement now or hereafter held by the city for a public purpose.
