§ 105.08 PERMITS AND FEES.
   Vendors must obtain all other appropriate licenses and permits when necessary; and may without notice be required to show such to any city representative.
   (A)   All vendors are required to reserve a lease space from the city at least seven days prior to setting up their booth. Reservations may be made at the approved permit office Monday through Friday, from 8:00 a.m. to 5:00 p.m., or on-line at the city website. All vendors will be required to enter into a Market Square lease space agreement with the city at the time of reservation. All lease space fees must be paid at the time of making the reservation. Lease space fees are:
Agricultural and artist/craftsperson vendors (no electricity, no water)

Agricultural and artist/craftsperson vendors (under metal awnings; with electricity, with water)
$10 per day
Ware vendors (with electricity, with water)

Food vendors (with electricity, with water)

   (B)   A city health permit will be required for food vendors who distribute, offer for sale, or sell food which is prepackaged or prepared on-site. All food vendors must meet all requirements of the Texas Food Establishment Rules found in Title 25, Chapter 229, Subchapter K, of the Texas Administrative Code, as amended, and § 105.09, Vendor Requirements, of this chapter. Health permits may be obtained from the City of Cleburne Health Department or on-line at the city website. An application for a health permit and payment of fee should be made at least 48 hours in advance of a scheduled event. Permit fees are listed in Chapter 94 of the Code of Ordinances. Food vendors with an approved City of Cleburne Health Department annual permit may operate at Market Square under such permit. Food vendors without an approved City of Cleburne Health Department annual permit shall obtain a temporary health permit from the City of Cleburne Health Department for each special event they set up at Market Square.
   (C)   A Texas Department of State Health Services manufacturer's license required for the sale of prepackaged foods, sauces, or produce that is packaged. These products must meet all manufactured food labeling requirements of the Department of State Health Services.
   (D)   Sales tax certificates must be present for those vendors required to pay sales tax as stated by the Comptroller's Office.
