§ 154.102 SEWER INSTALLATION POLICY.
   (A)   Sewer installation distance requirements.
      (1)   All developers shall extend sanitary service to the city sewer mains if the development is within the following distances to the nearest existing sanitary sewer line that has adequate capacity, as determined by the City Engineer:

      (2)   Parcels subdivided on a piecemeal basis will be considered based on the aggregate number of lots.
   (B)   On-site sewage systems.
      (1)   If the developer is not required to extend public sewer in accordance with division (A)(1) above, on-site sewage systems may be considered. The requirements for on-site sewage systems are as follows:
         (a)   A minimum lot size of one acre;
         (b)   On-site sewage facilities be designed in accordance with county and state regulations;
         (c)   On-site sewage facilities utilize less than 50% of the area of the lot;
         (d)   None of the on-site sewage facility is located within any easement;
         (e)   None of the on-site sewage facility is located within the floodplain;
         (f)   Property owners with on-site sewage systems are required to have the system inspected by Building Inspections Department at the property owner’s expense upon installation, alteration, or as a response to complaint(s) related to system malfunction. A copy of the report must be provided to the city.
         (g)   Existing, properly functioning on-site sewage systems may continue to be utilized until public sanitary system is available to the property. The Director of Public Works shall be the regulatory authority determining if an on-site sewage system is functioning properly.
         (h)   All abandoned septic tanks shall be properly filled with sand in accordance with the current standards.
         (i)   Permits for new or replacement on-site sewage systems within the city limits shall be obtained from the city. On-site sewage facilities within the city’s ETJ are under the jurisdiction of Johnson County.
         (j)   If a new or replacement on-site sewage system is needed and a city wastewater utility line is located within either the street right of-way or an easement adjacent to the property, the property shall be required to connect to the city’s wastewater system.
      (2)   In addition to the above requirements, any subdivision or portion thereof lying within 1,300 feet of the service spillway level (elevation 733.5 feet above mean sea level) of Lake Pat Cleburne, shall follow provisions set out in § 98.058 of this code of ordinances and state and county regulations in order to place an on-site sewage system.
