§ 30.99 PENALTY.
   (A)   Generally. Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   Prohibited smoking in public places. Any person who smokes on the Town of Clayton’s property where smoking is prohibited, as set forth in § 30.01, shall be guilty of a misdemeanor and upon conviction shall be fined from $100 up to $300 or imprisoned for up to 6 months, or receive both the fine and imprisonment.

   (C)   Unlawful to refuse to leave a public educational facility when asked by an employee to leave. Any person found to have violated § 30.02 shall be guilty of a misdemeanor, and upon conviction thereof, shall be fined not more than $50 for each violation. Any person convicted of a violation of this section 3 or more times shall be subject to imprisonment for not more than 2 days for the third and each subsequent violation in addition to being fined.
