§ 71.06 RESIDENT-ONLY PARKING; FEES.
   (A)   The provisions of this section shall be considered the enabling ordinance for the establishment of resident-only parking regulations, and all future and all previously issued permits for resident-only areas shall conform to the following:
      (1)   A person wishing to apply for a resident-only parking zone shall obtain and submit an application from the office of Planning Department. If a medical condition is cited as a reason for the zone, the applicant must provide a practitioner’s certification on a form provided by the Planning Department.
      (2)   The application shall be submitted to the Planning Department’s technical review committee for review. The applicant will be notified of the date his or her application will be reviewed by the technical review committee. The applicant must appear for that meeting, unless his or her appearance is excused by the Planning Director. Failure to appear at the technical review committee meeting may result in an unfavorable recommendation regarding the application.
      (3)   The technical review committee shall review the applicant for compliance with the town’s ordinances and consider the appropriateness and necessity of the resident-only parking zone for the particular street, location, and stated need for the zone.
      (4)   A resident-only parking zone shall be a maximum of 20 feet in length and shall be marked by a sign and paint marks on the curbing and/or street at each end of the resident-only space, the placement of which shall be determined by the Street Department.
      (5)   No resident-only parking zone will be issued for parking on a cul-de-sac.
      (6)   Following its review, the technical review committee shall make a recommendation to the Town Council regarding the application.
      (7)   The Town Council shall review the recommendation and either accept or reject the application which shall be in force for a period not to exceed three years.
      (8)   If the application is approved, the initial fee for each resident-only parking space shall be $100 and shall cover the placement of signs and markings for the remainder of the calendar year for the year in which the permit is initially issued.
   (B)   (1)   If the applicant wishes to renew the resident-only parking zone for each of the two following years after issue, a renewal application must be submitted by February 1 of the subsequent year along with a renewal fee of $50. Failure to submit a renewal application will result in the revocation of the previous permit.
      (2)   If a renewal application is not made by February 1 of the subsequent two years, the Street Department shall remove any and all signs and markings from the previously designated resident-only parking zone.
      (3)   If a renewal application is timely made and the renewal fee timely paid, the technical review committee shall review the renewal application and make a recommendation to the Town Council regarding renewal.
   (C)   It shall be unlawful for a vehicle belonging to one other than the applicant or his or her designee to park in a resident-only parking zone.
   (D)   Signs designating resident-only parking may be erected within the town.
