Adopting Ordinance
ORDINANCE NO. 95-G-05
ENACTING AS AN ORDINANCE A CODE OF ORDINANCES FOR THE TOWN OF CLARKSVILLE, INDIANA, REVISING, AMENDING, RESTATING, CODIFYING, AND COMPILING CERTAIN EXISTING ORDINANCES OF THE TOWN DEALING WITH SUBJECTS EMBRACED IN SAID CODE
WHEREAS, the current manner of arrangement, classification and indexing of general ordinances of the Town of Clarksville, including the range of subject matter included in a prior code of ordinances, has become insufficient to meet the immediate needs of the Town; and
WHEREAS, the Acts of the State Legislature of the State of Indiana empower and authorize the revision, amendment, restatement, codification, and compilation of any existing ordinance or ordinances and all new ordinances not heretofore adopted or published, and further empower the incorporation of said ordinances into one ordinance in book form;
NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Clarksville, Indiana, that:
Section 1. The general ordinances of the Town of Clarksville as herein revised, amended, restated, codified, and compiled in book form are adopted as and shall constitute the “Code of Ordinances of the Town of Clarksville, Indiana.”
Section 2. This Code as adopted in Section 1 shall consist of the following initial titles, to-wit:
Title I General Provisions;
Title III Administration;
Title V Public Works;
Title VII Traffic Code;
Title IX General Regulations;
Title XI Business Regulations;
Title XIII General Offenses;
Title XV Land Usage;
Table of Special Ordinances;
Parallel References; and
Index.
Additional titles and/or sections may be added from time to time as they are deemed to be made necessary or desirable through future legislation and subsequent routine supplementation processes.
Section 3. All ordinances pertaining to the subjects treated in this Code adopted on or prior to February 13, 1995, with the exception of Ordinance No. 95-ST-01 adopted on 1-9-95, she be deemed repealed from and after the effective date of this Code; provided that 1) such repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of said Code, 2) such repeal shall not affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory establishing franchises or granting special rights to certain persons, authorizing public improvements, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, granting or accepting easements, plat or dedication of land to public use, naming or vacating or setting the boundaries of streets, alleys, or other public places, nor to any other ordinance of a temporary or special nature or pertaining to subjects not contained therein; 3) such repeal shall not be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance which is repealed by this ordinance.
Section 4. Any and all ordinances of a general nature adopted after the date February 13, 1995, pertaining to and/or amending topics treated in this Code or deemed as a subject matter necessary as an additional topic for this Code, when passed in a manner as to indicate the intent of the Council to make the same a part of this Code, shall be deemed incorporated in this Code so that reference to this Code shall be understood and intended to include such additions, even prior to the publication of routine supplements to this Code in which these ordinances are included.
Section 5. Said Code shall be deemed published and in full force and effect as of the day of its adoption and approval by the Council of the Town of Clarksville, and one copy of said Code shall be filed and maintained in the Office of the Clerk-Treasurer of the Town of Clarksville.
