§ 36.365 CREATED.
   (A)   A non-reverting fund is hereby established titled "Clarksville Animal Control Non-Reverting Fund" for the purpose of receiving, holding and dispersing fees that have been received pursuant to the Animal Control Ordinance. Hereafter the Clerk-Treasurer shall not deposit into the General Fund or other funds any fees received pursuant to the Animal Control Ordinance but shall deposit those funds into said non-reverting fund.
   (B)   The funds to be deposited into the Clarksville Animal Control Non-Reverting Fund shall only include fees collected pursuant to the Animal Control Ordinance and not fines imposed and collected pursuant to the ordinance.
   (C)   The funds from the Clarksville Animal Control Non-Reverting Fund may be used for reasonable and necessary expenditures for supplies, equipment, and/or vehicles and other expenses for enforcement of the Animal Control Ordinance. Monies from the Clarksville Animal Control Non-Reverting Fund may be dispersed without appropriation in payment after:
      (1)   The filing of a proper claim by the Director of the Public Works Department; and
      (2)   The issuance of a warrant by the Clerk-Treasurer.
   (D)   The provisions of this subchapter shall apply to Chapter 91 as enacted and as may be subsequently amended or replaced.
   (E)   Claims under this subchapter may be treated as preapproved claims pursuant to IC 36-5-4-12.
   (F)   Authorization for the fund shall expire when the Director of the Public Works Department notifies the Town Council that the purposes of the fund no longer exist or a subsequent ordinance so provides and any funds remaining in the account shall be transferred to the Town General Fund.
