1712.07 CODE ENFORCEMENT DIRECTOR.
   (a)   Position. The position of Code Enforcement Director is hereby created by the Council of the City of Clarksburg. The Code Enforcement Director shall be considered an employee of the City of Clarksburg and work in The Office of Code Enforcement.
   (b)   References to "Building Code Official" in the Codified Ordinances shall hereafter be modified to read as references to Code Enforcement Director and the Code Enforcement Director shall have the same duties and obligations as the now-withdrawn position of Building Code Official.
   (c)   Scope and Job Duties. The Code Enforcement Director is tasked with overseeing all functions of The Office of Code Enforcement of the City of Clarksburg.
These duties shall include, but not be limited to, the following:
      (1)   Oversee the enforcement of the City of Clarksburg's adopted building codes and zoning procedures;
      (2)   Supervise one or more Deputy Code Officials, including Building Inspectors, Building . Plans Examiners, and other administrative and technical staff employed by the Code Enforcement Department;
      (3)   Examine construction documents to ascertain compliance with provisions of the State Building Code;
      (4)   Perform field inspections to determine compliance with approved plans and code requirements;
      (5)   Enforce the relative administrative provisions of the State Building Code such as supervising building code inspectors or plans examiners, issues building permits, occupancy permits, notices of violations and orders, and initiates the compulsory process;
      (6)   Oversee the maintenance of accurate documentation and case files on all investigations, inspections, enforcement actions, and other job related activities including accurate and detailed information regarding code enforcement activity to substantiate violations;
      (7)   Prepare evidence in support of legal actions taken by the City; appear in court as necessary; testify at hearings and in court proceedings as required;
      (8)   Attend meetings as needed and serve as a resource to other City departments, divisions, the general public, and outside agencies in the enforcement of zoning regulations;
      (9)   Provide research and documentation for meetings when required;
      (10)   Participate in supervising the work of community service workers, county inmates, or volunteers engaged in community clean-up and preservation activities within the city limits of the City of Clarksburg;
      (11)   Participate in the development of forms and processes utilized to address various issues related to The Office of Code Enforcement;
      (12)   Interpret and explain municipal codes and ordinances to members of the general public, contractors, business owners, and other interested groups; and
      (13)   Perform related duties as required.
   (d)   Qualification. At the time of hiring or within three months after, the Code Enforcement Director must qualify as a Code Official pursuant to West Virginia Code§ 29-3-5 and W. Va. C.S.R. § 87-7-1 et seq., including any and all educational and licensing requirements, both from the West Virginia State Fire Marshal and third-parties.
   (e)   Appointment. The Code Enforcement Director shall be appointed by the City Manager.
   (f)   Removal. The Code Enforcement Director serves at the will and pleasure of the City Manager.
   (g)   Conflicting Ordinances. All Ordinances or parts of Ordinances in conflict with the provisions of this section are hereby repealed to the extent of such conflict.
   (h)   Severability. If any subsection, sentence, clause, phrase, or word of this Section be for any reason declared unconstitutional or invalid or ineffective by any court of competent jurisdiction, such declaration shall not affect the validity or the effectiveness of the remaining portions of this section or any part thereof which can be given meaning without the offensive subsection, sentence, clause, phrase or word.
