Section 10 of the City Charter allows for the establishment of a municipal court and the appointment of a municipal judge. The municipal court shall have the power and authority to issue warrants upon compliant under oath of any person or officer for the arrest of anyone charged with any offense within the court’s jurisdiction. The municipal court also has the power to sentence any individual convicted of any offense or violation of the ordinances passed by the City of Clarksburg and to require of the Chief of Police the enforcement of all judgments or orders entered by him in the exercise of its powers as the municipal court for the City of Clarksburg. The Council has found and determined that it would be in the best interests of the City of Clarksburg to allow the municipal court and sitting municipal judge thereof to sentence those persons convicted in municipal court to the alternative sentence of community service. The Council further finds and determines that this alternative sentence of community service will be beneficial in both reduce the rate of offenses and also in assisting with the maintenance of property owned or maintained by the City of Clarksburg.
