1767.04.2 ORDER OF ABATEMENT.
   (a)   The Chief of Police, or any authorized representative of the City as designated by the City Manager may bring action to abate an illicit activity, as defined herein, to be commenced in the name of the City from a court of competent jurisdiction, which shall include the Clarksburg Municipal Court, which is hereby conferred such authority hereunder, in the form of a Notice of Violation or a Citation.
   (b)   The Chief of Police or any authorized representative of the City as designated by the City Manager shall issue a Notice of Violation or Citation containing an Order of Abatement upon finding liability under this section.
   (c)   The Order of Abatement shall contain the requirements for the defendant to initiate measures reasonably calculated to prevent the reoccurrence of the illicit activity.
   (d)   The Order of Abatement may also authorize the issuance of a search warrant reasonably calculated to determine whether the illicit activity has been abated or the order of the court has been obeyed.
   (e)   The Order of Abatement may also require the owner, manager or person having control of the property to secure a background check for any future tenants prior to allowing occupancy and submit verification to the Code Enforcement Office.
