(a) Duty to Amend Registration Statement. If the status of the registration information changes during the course of any calendar year, it is the responsibility of the owner, responsible party or agent for the same to contact the Department of Licenses and Inspections within thirty (30) days of the occurrence of such change and advise the Department in writing of those changes.
(b) Exceptions. This section shall not apply to any building owned by the United States, the State of West Virginia, the City, or any of their respective agencies or political subdivisions.
(c) Violations and Penalties for Failure to Register. The failure or refusal for any reason of any owner, or agent of an owner acting on behalf of the owner, to register a vacant building upon adoption of this section or to pay any fees required to be paid pursuant to the provisions of this section, within thirty days after they become due, shall constitute a violation punishable upon conviction thereof by a fine in the amount set forth in Section 1712.06(n) Violation Penalties. Any person who shall violate a provision of this article or fail to comply therewith, or with any requirements thereof, shall be prosecuted within the limits provided by state or local laws.
(1) Whoever violates a provision of this Article pursuant to this section shall be fined not less than two hundred and fifty dollars ($250.00) nor more than five hundred dollars ($500.00).
(2) Whoever violates the same provision of this article previously fined under subsection (n) hereof for the second time shall be fined not less than five hundred dollars ($500.00) nor more than ($1,000.00).
(3) Whoever violates the same section of this article previously fined under subsection (n) hereof for the third and each consecutive time shall be fined not less than one thousand dollars ($1,000.00) nor more than three thousand dollars ($3,000.00).
