1707.02 PERMIT TO OCCUPY A STREET OR SIDEWALK REQUIRED.
   (a)    Any person, corporation or public utility desiring to occupy a City street or public sidewalk shall obtain a permit from the Director of Public Works or Code Enforcement Office prior to occupying the street or sidewalk.
   (b)    Any person, corporation, unincorporated association or public utility desiring to make an excavation within any City right of way, cut any pavement or curb within any City right of way, or undertake existing improvements within the City right of way, shall be required to obtain an excavation and street cut permit.
   (c)    Any entity, duly licensed to do business in the City, and maintains a physical business location in the Central Business District, may display, sell, or offer for purchase any inventory of goods, related to that business on the sidewalk fronting the said physical business location under the following limitations:
      (1)    There must be a clear path of travel of forty-eight (48) inches in the area of the display.
      (2)    Goods may be displayed only between the hours 8:00 a.m. to 4:00 p.m. Monday through Saturday.
      (3)    The activity of displaying, selling, or offering for purchase goods on the sidewalk, in the Central Business District is limited to no more than three (3) times per year.
      (4)    The entity wishing to display, sell, or offer for purchase goods on the sidewalk, must also obtain a "Permit To Occupy Sidewalk" issued by the Code Enforcement Office.
      (5)    Exempted from the prohibition of this Article, are all businesses located in the shopping plazas situate on Emily Drive.
