No person shall build or construct any building, structure or other thing over a right of way held by the City or the Sanitary Board for storm, sanitary or combined sewers, without first having obtained the written permission of the City Engineer or the Sanitary Board Engineer, provided that such right of way is evidenced by a written grant or agreement recorded in the office of the Clerk of the County Commission of Harrison County. A violation of this section shall make the person violating the provision subject to the penalty provided in Section 925.99. A violation shall also make the person violating such provision liable for any damage or expense caused to the City or the Sanitary Board, or its sewers, by such violation.
