507.05 RESTRAINT.
   (a)   Restraint While Off Premises or Property.
      (1)   The owner shall keep his dog or cat under restraint at all times and shall not permit such dog or cat to be at large, off the premises or property of the owner, unless under the control of a competent person.
      (2)   Whoever violates subsection (1) hereof shall be subject to the following fines and penalties:
         A.   First violation: A mandatory minimum fine of not less than twenty-five dollars ($25.00);
         B.   Second violation: A mandatory minimum fine of not less than two hundred dollars ($200.00);
         C.   Third violation: A mandatory minimum fine of not less than three hundred dollars ($300.00);
         D.   Fourth violation: A mandatory minimum fine of not less than four hundred dollars ($400.00);
         E.   Fifth and subsequent violation: A mandatory minimum fine of not less than five hundred dollars ($500.00).
      (3)   There shall be no exceptions to or waivers of the fines and penalties provided for in subsection (2) hereof.
      (4)   In addition to imposing the mandatory minimum fines and penalties provided for in subsection (2) hereof, the municipal judge shall have plenary power and authority to order and direct any person found to be in violation of subsection (1) hereof to take necessary action to come into compliane therewith within a reasonable period of time. Failure to comply with such order and directive of the municipal judge shall constitute a separate offense and result in the imposition of an additional fine of not more than five hundred dollars ($500.00).
   (b)   Injury to Person, Animal or Property. Should any dog, while running at large, bite, or otherwise inflict injury upon any person, animal or property, the person or owner having charge of any such dog shall be guilty of a misdemeanor, shall be fined not less than one hundred dollars ($100.00) and not more than one thousand dollars ($1,000), and may be ordered by the Municipal Judge to provide restitution, where appropriate. A conviction for the violation of this particular subsection shall not be a prerequisite for the filing of a civil action by the victim of any such dog incident.
