(a) Any person eighteen years of age or older who violates any provision of this article shall be fined not more than one hundred dollars ($100.00).
(b) Any parent or guardian violating any portion of this article shall be fined twenty- five dollars ($25.00) for the first violation. Any parent or guardian violating any portion of this article a second time shall be fined one hundred dollars ($100.00) for the second violation. Any parent or guardian violating any portion of this article a third time or more shall be fined up to five hundred dollars ($500.00) for each third or more violation.
(c) When any person is charged with a violation of this article, the skateboard or similar device of that person shall be seized by the charging officer. Upon conviction for a first or second offense and payment of the applicable fine, or upon any acquittal, such skateboard or similar device shall be returned to the offender. Upon conviction for a third or subsequent offense, such skateboard or similar device shall be forfeited to the City.
(d) Court costs shall be applicable to each violation.
