303.14 ABANDONED AND JUNK VEHICLES; PENALTIES.
   (a)   No person shall abandon any motor vehicle within the City. No person shall leave any motor vehicle at any place within the City for such time and under such circumstances as to cause such vehicle to appear to have been abandoned.
   (b)   No person shall leave any unlicenced, partially demolished, non-operating, jacked or junked motor vehicle on any street, lane or any other public property within the City.
   (c)   No owner of any property within the City, or any person in charge or control of any property within the City, whether as owner, tenant, occupant or otherwise, shall allow any partially dismantled, non-operating, wrecked, junked or discarded motor vehicle to remain on such property for more than seventy-two hours. No person shall leave any such vehicle on any property within the City for more than seventy-two hours.
   (d)   This section shall not apply to any vehicle stored or placed in an enclosed building, nor to any vehicle on the premises of a business enterprise operated in a lawful place and manner, and when necessary to the operation of such business enterprise.

   (e)   When any motor vehicle has been abandoned or junked on private or public property as provided in this section and in West Virginia Code § 17 -24A-1, et. seq., police officers and/or Code Enforcement Officials are authorized to provide for the removal and impounding of any such vehicle. When such vehicles are on private property, before such vehicles are removed and impounded, the owner of any such private property within the City, or any person in charge or control of such private property within the City, whether as owner, tenant, occupant or otherwise, shall be notified to remove such vehicle within 30 days, and if such vehicle is not removed within such time period, it may be removed or impounded as stated above.    (f)   Any vehicle that has been removed and impounded under the authority of subsection (e) hereof shall be disposed of as provided under West Virginia Code 17-24-1 et seq. (Ord. 98- 24. Passed 7-30-98.)
