Whenever, in the Codified Ordinances or in any ordinance of the City, any act is prohibited or is made or declared to be unlawful or an offense, or whenever the doing of any act is required or the failure to do any act is declared to be unlawful, where no specific penalty is otherwise provided, whoever violates any such provision shall be fined not more than five hundred dollars ($500.00). However, such penalty shall not exceed the maximum penalty provided by State law for the commission of a misdemeanor which is the same or similar to the act prescribed by the City. Notwithstanding any other provisions of these Codified Ordinances to the contrary, where any ordinance of the City provides for a specific penalty, such penalty, from and after November 1, 1989, shall not include any period of incarceration.
