927.07 EXTRA STRENGTH SURCHARGE.

   (a)   Where flows and loads are discharged in excess of the limitations established in Section 925.01(16), a surcharge over and above the charges established in Section 927.06 shall be levied on all flow and loadings which are in excess of such limitations.

   (b)   The surcharge rate shall be calculated annually in accordance with the volumes and amounts established in Section 927.05, to be effective January 1 of each year and to be figured by the following formula:

      Annual surcharge = (Bw) + (Sx) + (Py) +(Oz), where:

   B   =   Hundreds of pounds of BOD discharged annually in excess of 300 mg/l;

   w   =   The BOD removal costs as mentioned in Section 927.05(h), divided by the value determined in Section 927.05(a)(2);

   S   =   Hundreds of pounds of SS discharged annually in excess of 300 mg/l;

   x   =   SS removal costs as mentioned in Section 927.05(h), divided by the value determined in Section 927.05(a)(3);

   P   =   Hundreds of pounds of phosphates discharged annually in excess of 25 mg/l;

   y   =   The phosphate removal costs as mentioned in Section 927.05(h), divided by the value determined in Section 927.05(a)(4);

   O   =   Hundreds of pounds of other pollutant discharge annually in excess of normal strength limitation; and

   z   =   The other pollutant handling costs as mentioned in Section 927.05(h), divided by the value determined in Section 927.05(a)(5).
