BOARD OF ADJUSTMENT
§ 32.01 ESTABLISHED.
   The Board of Adjustment is hereby established, as provided in MCA § 76-2-321.

§ 32.02 COMPOSITION.
   The Board of Adjustment shall consist of not less than five or more than seven members to be appointed by Town Council for terms of three years. If the Council does not make appointments otherwise each member of the Town Council shall also serve as a member of the Board of Adjustment, as provided in MCA § 76-2-322.

§ 32.03 MEETINGS.
   (A)   Meetings of the Board of Adjustment shall be in the Council Chambers of the Town Hall, at a reasonable time for the hearing of an appeal. Prior to the hearing, public notice shall be given, as well as due notice to the parties of interest.
   (B)   The concurring vote of four members of the Board shall be necessary to reverse any order, requirement, decision, or determination of any such administrative officials, or to decide in favor of the applicant on any matter upon which it is required to pass under any such ordinance, or to effect any variation in such ordinance.

§ 32.04 POWERS AND DUTIES.
   The powers and duties of the Board of Adjustment shall be as defined in MCA § 76-2-323.

§ 32.15 CREATION.
   There is hereby created the Street, Water, and Sewer Department for the purposes of maintaining and operating the streets, alleys, water, and sewer facilities.
