359.07 JUNK MOTOR VEHICLE; COLLECTOR'S VEHICLE; NOTICE.
   (a)   For purposes of this section, “junk motor vehicle” means any motor vehicle on private or public property meeting the requirements of subsections (b) and (c) of Section 359.05. No junk motor vehicles shall be left for seventy-two consecutive hours or more outside the confines of a garage or other building that conceals such motor vehicle from view.
   (b)   Motor vehicles on private property excluded from the definition of junk motor vehicle include vehicles on private property under the following circumstances:
      (1)   Which property is operated as a junk yard or scrap metal processing facility regulated under authority of a political subdivision or licensed under authority of Ohio R.C. 4737.05 to 4737.12;
      (2)   Which property is not subject to licensure or regulation by any governmental authority; and
      (3)   Wherein the vehicle is a necessary part of a bona fide commercial operation.
   (c)   A motor vehicle on private property meeting the requirements of Section 359.05(b) and (c), but which is claimed or considered in good faith to be a collector’s vehicle by the owner of the vehicle or by the person having the right to the possession of the property on which such vehicle is located shall, except for periods of time not to exceed seventy-two consecutive hours, be confined in a garage or other building which conceals such motor vehicle from view. Said collector vehicle shall be registered as a collectible vehicle with the Ohio Bureau of Motor Vehicles and display valid collector tags.
   (d)   No person shall willfully fail to remove from private property or willfully leave a junk motor vehicle or collector’s vehicle meeting the requirements of Section 359.04(b) and (c), unconcealed from view as required by subsections (a) or (c) hereof, after having received notice of said violation.
   (e)   The Chief of Police, or any police officer designated by the Chief of Police, may order into storage any junk motor vehicle or collector’s vehicle, when the possessor/owner has failed to become compliant with section (d) herein. Upon the order of storage being issued, the vehicle shall be subject to disposal in accordance with Section 359.05 pursuant to the same procedures as abandoned junk motor vehicles.
