351.041 RESIDENTIAL HANDICAP PARKING SPACES.
   (a)   Applying for Residential Handicapped Parking Space. Any severely handicapped person living within the boundaries of the City of Chillicothe may apply for a residential handicapped parking space.
      (1)   Severely handicapped person means “any” person who has lost the use of one or both legs, or one or both arms, or so severely handicapped as to be unable to move about without the aid of crutches or wheelchair, or whose mobility is severely restricted by a permanent cardiovascular, pulmonary or other handicapped condition.
   (b)   Requirements for Obtaining Residential Handicapped Parking Space. Prior to obtaining a residential handicapped parking space, it shall be the applicant’s responsibility to provide or secure the following documentation to process the application and to provide such information to the Safety-Service Director.
      (1)   The applicant must provide a doctor’s statement on a form prescribed by the City of Chillicothe stating the applicant’s medical condition is so severe that a handicapped parking space as close as possible to the applicant’s residence is necessary to assist in transportation to and from the residence.
      (2)   The applicant must have a special handicapped license plate issued by the State of Ohio, a pending application for the special handicapped license, or a State approved handicapped parking placard.
      (3)   The applicant must provide documentation on a form prescribed by the City of Chillicothe that no private or off-street parking space is available which is sufficient to meet transportation needs. When off-street parking is available, the documentation must include a detailed diagram with measurements showing why on-street parking is preferable to the available off-street parking.
      (4)   A severely handicapped person or their delegate may secure an application for the residential handicapped parking space by contacting the Safety- Service Director. The completed application must be delivered to the Office of the Safety-Service Director. The application will be reviewed by the Safety-Service Director, Chief of Police and City Engineer; and a determination made concerning the residential handicapped parking space. The applicant must secure a “Restricted Parking Permit” from the Office of the Engineer. The permit will be assigned a number to correspond with the number to be assigned to the painted space and will identify the vehicle authorized to use the handicapped parking space.
      (5)   Upon approval by the Safety-Service Director, Chief of Police and City Engineer, the Engineering Department will be directed to arrange for the posting of a handicap symbol parking sign with the permit number and the vehicle’s license plate number on it and the painting of a 24 foot long parking space with the Handicapped Parking Symbol in reflective blue paint at a public street location closest to the applicant’s residence. No handicapped parking spaces will be issued within a business district as defined by the attached map(s), marked as “Exhibit A” to original Ordinance 77-01, or anywhere regulated parking is present.
   (c)   Annual Renewal. Residential handicapped parking spaces must be renewed annually by and for the person to whom the original space was issued. The renewal request must be made thirty days in advance of the expiration of the permit following the same procedure as required in the original application. Residential handicapped parking permits are nontransferable.
   (d)   Removal of Handicapped Parking Space.
      (1)   If for any reason, the parking space is no longer needed by the person to whom it was originally issued, the handicap parking symbol, space and sign will be removed by the Engineering Department.
      (2)   A residential parking permit may be revoked upon determination made after review by the Safety-Service Director, Chief of Police and City Engineer, that the privilege has been abused, misused, or for disregarding the rules set forth in this section; or for tampering with or altering the permit placard.
   (e)   Records File. 
      (1)   Upon approval of a special on-street parking location for the handicapped, the Traffic Control Map and File established under the provisions of Section 305.01 of the Codified Ordinances of the City of Chillicothe, Ohio, shall be amended to conform to the provisions of this section, and the appropriate City officials are hereby authorized and directed to install the necessary signs, equipment and markings to designate the changes established by this section.
      (2)   The appropriate City officials, pursuant to Section 305.03 of the Codified Ordinances are hereby authorized and directed to amend the Traffic Control Map and File to conform to the provisions of this section and to provide a copy of the approved on-street handicapped parking permit to the Police Department for inclusion in its records and for marking the Control Map and File.
      (3)   The Engineering Department is required to maintain an up-to-date file of issued handicapped parking spaces.
   (f)   Violations.
      (1)   No person shall park any vehicle other than the assigned vehicle within the boundaries of the assigned handicapped parking space. This applies to all vehicles including other vehicles owned by the applicant, vehicles of other family members, care providers and other handicapped vehicles.
      (2)   No person shall fail to park the vehicle assigned to a residential handicapped parking space other than fully within the boundaries of the assigned handicapped parking space.
   (g)   Fees.
(1)   $50.00 fee for first time applicants for erection of sign. Fee will be collected after application has been approved.
      (2)   $10.00 annual renewal fee.
      (3)   $25.00 fee if any changes need to be made to sign after initial placement.
