(a) No person shall operate any vehicle of more than one-half ton capacity, except passenger vehicles, upon West Water Street between Western Avenue and West Second Street. However, this prohibition shall not apply to any vehicular traffic going to or from any premises located thereon.
(b) The Director of Public Safety is authorized to install the necessary signs to designate the weight limitations imposed by this section.

(c) Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
