728.03 LICENSING AND INSPECTION OF COMMERCIAL QUADRICYCLE AND COMMERCIAL PEDAL WAGON OPERATIONS.
   No person shall solicit, drive, operate, or otherwise be in physical control of any Commercial Quadricycle and/or Commercial Pedal Wagon for the purpose of carrying the public generally as passengers for hire, gift, donation, or other consideration unless:
(a)   The owner of such Commercial Quadricycle has successfully passed an annual inspection by the Chillicothe Police Chief, or his designee;
(b)   The owner of such Commercial Pedal Wagon has successfully passed an annual low-speed vehicle inspection by the Ross County Sheriff’s Department in compliance with the State of Ohio’s statutory requirements applicable to motor vehicles and licensed through the BMV.
(c)   The Commercial Quadricycle and.or Commercial Pedal Wagon is equipped with the following at all times:
(1)   Adequate brakes and braking system, including a parking brake.
(2)   Two headlamps capable of emitting a white light visible at a distance of at least 1,000 feet ahead of the pedal wagon.
(3)   Two taillights capable of emitting a red light visible at least 1,000 feet from the rear of the pedal wagon.
(4)   Functioning battery to operate the headlights and taillights.
(5)   Reflective material on both sides and the rear of the vehicle so as to tender the vehicle visible from a distance of 500 feet.
(6)   A triangular slow-moving vehicle (SMV) emblem mounted on the rear of the vehicle.
(7)   A public vehicle license displayed so that it can be easily seen.
(8)   Seat belts for each passenger and any other device ordered by the Mayor.
(d)   The owner of such Commercial Quadricycles and/or Commercial Pedal Wagons has obtained a City of Chillicothe permit issued by the Mayor, or designee, for each quadricycle and pedal wagon.
(e)   Each driver of the licensed Commercial Quadricycle and/or Commercial Pedal Wagon has a valid driver’s license.
(f)   Each quadricycle, pedal wagon and each driver is insured for liability coverage in at least the amount of the state minimum for motor vehicle operators in the State of Ohio and written verification of said liability coverage is provided to the Mayor.
(g)   The current license is clearly displayed on each quadricycle and/or pedal wagon.
