(a) Any interested party may appear before the Nuisance Abatement Board and request a determination that the nuisance is abated or that the plan to ensure that the conduct, activities or conditions constituting the nuisance will not re-occur has been completed or initiated. The interested party shall request to make such an appearance on a form prescribed by the Board.
(b) If a majority of the members of the Nuisance Abatement Board determine the interested party has abated the nuisance or has completed or initiated the plan to ensure that the conduct, activities or conditions constituting the nuisance will not re-occur, the Board shall advise the interested party and the Enforcement Official of that determination and the next, subsequent nuisance event shall be deemed a first nuisance event subject only to the notice requirements set forth in Section 138.06(a).
