911.16.33 ENFORCEMENT MANAGEMENT STRATEGY.
   (a)    Offense. For purposes of this section an "offense" is defined as follows:
      (1)    Failure to submit requested documents;
      (2)    Failure to maintain required on site records;
      (3)    Failure to maintain interceptor (minimum 90-day pumping or as directed by Authority);
      (4)    Any circumstance that impedes the proper operation or inspection of the facility's grease interceptor;
      (5)    Failure to take the necessary corrective actions within 10 days of the receipt of a violation notice.
   Each occurrence of a failure shall be considered a separate "offense".
   (b)    Action. The following actions will be taken for each offense:
      (1)    First Offense (within a 12-month period): Verbal notification and warning by the Authority with a follow-up letter. The offense shall be corrected within 30 days.
      (2)    Second Offense (within a 12-month period): Letter of violation with corrective actions required.
      (3)    Third Offense (within a 12-month period): Second letter of violation with a copy sent to the Office of the Utilities Director.
      (4)    Fourth Offense (within a 12-month period): Letter of violation sent by certified mail. Copy of violation letter sent to the Utilities Director for legal action as allowed by Section 911.99 .
