911.16.03 ACCIDENTAL DISCHARGES.
   (a)    Each discharger shall provide protection from accidental discharge of prohibited or regulated materials or substances established by this section. Where necessary, facilities to prevent accidental discharge of prohibited materials shall be provided and maintained at the discharger's cost and expense. Detailed plans showing facilities and operating procedures to provide this protection shall be submitted to the Authority for review, and shall be approved by the Authority before construction of the facility. Each existing discharger shall complete its plan and submit same to the Authority within three months of discovery and notification by the Authority. No discharger who discharges to the POTW after the aforesaid date shall be permitted to introduce pollutants into the system until accidental discharge protection procedures have been approved by the Authority. Review and approval of such plans and operating procedures by the Authority shall not relieve the discharger from the responsibility to modify its facility as necessary to meet the requirements of this chapter.
   (b)    New Significant Industrial Users will be evaluated for the need to develop a Slug Discharge Control Plan within one year of being designated a Significant Industrial User. The Authority wilt notify the User that a Slug Discharge Control Plan is required. For the purposes of this subsection, a Slug Discharge is any discharge of a non-routine episodic nature, including but not limited to an accidental spill, a non-customary batch discharge, which has the reasonable potential to cause Interference or Pass Through, or in any other way violate the Authority's or POTW's regulations, local limits or permit conditions. All existing Significant Industrial Users will be evaluated for the need to develop a Slug Discharge Control plan prior to renewing a discharge permit. Significant Industrial Users are required to notify the Authority or POTW immediately of any changes at its facility affecting potential for a Slug Discharge. If the Authority or POTW decides that a Slug Control plan is needed, the plan shall contain, at a minimum, the following elements:
      (1)    Description of discharge, including non-routine batch dischargers;
      (2)    Description of any stored chemicals;
      (3)   Procedures for immediately notifying the Authority or POTW of Slug Discharges, including any discharge that would violate a prohibition under Section 403.5(b) of the Act with procedure for follow up written notification within five days;
      (4)    Procedures to prevent adverse impact from accidental spills, including inspection and maintenance of storage areas, handling and transfer materials, loading and unloading operations, control of plant site run-off, worker training, building of containment structures or equipment, measures for controlling toxic organic pollutants (including solvents), and other measures and equipment for emergency response.
   (c)    The permitted user shall notify the Authority or POTW immediately upon the discharge of a slug load. The notification shall include the location of the discharge, type of waste, concentration and volume. The notification should report any corrective actions that were taken by the permitted user. A written detailed report shall be submitted within five days of the discharge event and shall include the following:
      (1)    Description of discharge practices, including non-routine batch discharges;
      (2)    Description of any stored chemicals;
      (3)   Procedures for immediately notifying the Authority or POTW of Slug Discharges, including any discharge that would violate a prohibition under section 403.5(b) of the Act with procedures for follow-up written notification within five days;
      (4)    Procedures to prevent adverse impact from accidental spills, including inspection and maintenance of storage areas, handling and transfer of materials, loading and unloading operations, control of plant site run-off, worker training, building of containment structures or equipment, measures for containing toxic organic pollutants (including solvents), and/or measures and equipment for emergency response.
   
   (d)    No discharger shall discharge or cause or allow to be discharged into the sewerage system any pollutant in concentrations above those specifically permitted in wastewater discharge permits issued by the Authority.
