(a) If the Utilities Director is satisfied after proper investigation that sufficient capacity exists in the sanitary sewer system and that a sanitary sewer tap would be in no way harmful to the community or the sanitary sewer system, he may issue a sanitary sewer tap permit upon payment by the applicant of all applicable fees established in subsection (f) of this section and compliance with all other requirements of this section.
(b) Payment in lieu of assessments, as a connection charge, shaft apply in cases where an assessment has been declared illegal, and has not been reassessed.
(c) The Utilities Director shall provide a monthly report of all sewer services connections requested outside the City, including the owner's name, location, action taken and comments, to the Clerk of Council who shall make written report distribution to the members of Council.
(d) All property owners contiguous to the City limits or located in a subdivision or platted area contiguous to the City limits shall be required to seek annexation to the City before any sewer tap is granted by the Utilities Director.
(e) All property owners not contiguous to the City limits shall provide in writing an agreement to annex into the City when asked by the City at any point in the future.
(f) Fee Schedule. The applicant shall pay the following applicable sewer tap fee:

(2) In order to ensure that owners of real property located within the area known as "Neenah Gardens", which was annexed to the City in 2000 pursuant to Ordinance No. 61-00, maintain the opportunity to obtain single family residential sanitary sewer taps at the cost available at the time of annexation, applicants connecting a residential dwelling unit to the Neenah Gardens Sewer System shall pay a sewer tap fee of three hundred dollars ($300.00) for each residential sewer tap fee within said system, provided that said tap connection is made no later than May 31, 2015.
(3) For units other than a single-family residential dwelling, including but not limited to a commercial, industrial, other nonresidential establishment, or apartments, the sewer tap fee will be based on the Ohio Environmental Protection Agency Sewage Flow Guide set forth in OAC 3745-42-05, as amended, times $1,000.00. In addition to the sewer tap fee, any unit without an existing wye shall pay $300.00 plus costs of material for a wye. The tap fee in this subsection (f) (3) is in addition to any special assessments levied against any of the properties or any payments in lieu of assessments as provided in Section 911.11
