911.02 DEFINITIONS.
   Unless the context specifically indicates otherwise, the meaning of the terms used in this chapter shall be as follows:
   (1)   "Act'' means the Clean Water Act (33 U.S. C. 1251 et seq.) as amended.
   (2)   “Action levels” means the concentration, based upon numeric value at the grease interceptor effluent, at the device outlet tee, and prior to mixing with any other wastewater from the contributing establishment's property, are expected to achieve on a consistent basis.
   (3)   "Authority" means the City of Chillicothe Utilities Department.
   (4)   "Best Management" or "Best Management Practices (BMP)" means schedules of activities, prohibitions of practices, maintenance procedures and other management practices to implement the prohibitions listed in Section 403.5(a)(1) and (b) of the Act. BMPs also include treatment requirements, operating procedures and practices to control plant site runoff, spillage or leaks, sludge or waste disposal or drainage from raw material storage.
   (5)   "B.O.D." denoting Biochemical Oxygen Demand means the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at twenty degrees centigrade, expressed in parts per million by weight.
   (6)   “Building drain" means that part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of a building and conveys the same to the building sewer beginning at a point three feet outside the face of the building.
   (7)   "Building sewer'' means the extension from the building drain to the public sewer and a connection thereto.
   (8)   "Bypass" means the intentional diversion of waste streams from any portion of an industrial user's treatment facility.
   (9)   "Categorical Pretreatment Standards" means National pretreatment standards specifying quantities or concentrations of pollutants or pollutant properties which may be discharged or introduced into a POTW by specific industrial dischargers.
   (10)   "CFR" means Code of Federal Regulations, Title 40 - Protection of Environment.
   (11)   “City” means the City of Chillicothe, Ohio.
   (12)   "Common Interceptor" means one or more interceptors, receiving FOG laden wastewater from more than one establishment. Common interceptors are located in shopping centers, malls, entertainment complexes, sporting arenas, hotels, multi-tenant flex spaces, mixed use spaces and other sites where multiple establishments are connected to a single grease interceptor. The owner of the property on which the common grease interceptor has been installed shall be primarily responsible for the maintenance, upkeep and repair of the common interceptor.
   (13)   “Cooling water” means the water discharged from any system of condensation, air conditioning, cooling, refrigeration or other. It shall be free from odor and oil and shalt contain no polluting substances.
   (14)   "Director" means the Utilities Director of the City.
   (15)   "Discharger" means any user who discharges wastewater into a POTW from any source regulated under 40 CFR 307(b), (c) or (d).
   (16)   "Engineer" means the City Engineer.
   (17)   “Fats Oils and Grease (FOG)" means organic (polar) compounds derived from animal and/or plant sources that contain multiple carbon chain triglyceride molecules. These substances are detectable and measurable using analytical test procedures established in 40 CFR 136, as may be amended from time to time. All are referred to as grease or FOG.
   (18)   "FOG Enforcement Response Plan" means the document and written plan and procedure by which the City implements an enforcement strategy applicable to FOG control and management program established herein. The plan applies to FOG program violations and matters of noncompliance addressed in this chapter and set forth in the City of Chillicothe, Ohio Pretreatment Ordinance. The City shall make site and case specific determinations as stipulated by the Ordinance.
   (19)   "Food Service Establishments or FSE" means those establishments primarily engaged in 'the activities of preparing, serving or otherwise making available for consumption food products that use one or more of the following preparation activities: cooking by frying (all methods), baking (all methods), grilling, sauteing, rotisserie cooking, broiling (all methods), boiling, blanching, roasting, toasting, poaching, infrared heating, searing, barbequing, and any other food preparation or serving activity that produces food products in or on a receptacle requiring washing for reuse.
   (20   "Garbage" means solid wastes from the domestic and commercial preparation, cooking and dispensing of food, and from the handling, storage and sale of produce.
   (21)   "Grease Trap or Interceptor" means a device for separating waterborne grease and grease complexes and retaining such grease and grease complexes prior to the wastewater exiting the trap and entering the sanitary sewer collection and treatment system. Grease traps also serve to collect user-generated solids that settle prior to the wastewater exiting the trap and entering the sanitary sewer collection and treatment system. Grease traps and interceptors are sometimes referred to as “grease interceptors”.
   (22)   "Indirect Discharge" means the discharge or the introduction of non-domestic pollutants from a source regulated under Section 307(b) or (c) of the Act, into a POTW.
   (23)   "Industrial Discharger" means any non-domestic user who discharges wastewater into a POTW from any source regulated under 40 CFR 307(b), (c) or (d).
   (24)   "Industrial waste" means any unwanted or unused solid, liquid or gaseous waste resulting from any industrial, manufacturing, trade, or business process or from the development, recovery or processing of natural resources as distinct from sanitary sewage.
   (25)   "Inspector'' means any person or individual appointed by the Director or the Engineer to inspect the construction of sanitary sewers or building sewers, and the connection of building sewers to sanitary sewers.
   (26)   "Interference" means the inhibition or disruption of a POTW's sewer system treatment processes or operations, which may contribute to a violation of any requirement of its NPDES permit.
   (27)   "Major Significant Industrial User" means the same as "Significant Industrial User" as defined in subsection (52) of this section.
   (28)   "May'' is permissive.
   (29)   "Minimum Design Capacity" means the design feature of a grease interceptor and its ability, or volume required, to effectively intercept greases and settlabte solids from grease-laden wastewater before discharge to the public sanitary sewer system.
   (30)   "Minor Significant Industrial User" means any industrial user not subject to Categorical Pretreatment Standards, which has a process wastewater discharge of less than five percent (5%) of the average dry weather hydraulic or organic capacity of the POTW wastewater treatment plant; which has a process water discharge of less than 25,000 gpd or is designated as such by the City on the basis that the Industrial User has minimal potential to cause pass through, interference or otherwise adversely affect the POTW.
   (31)   "New source" means any building, facility or installation from which there is or may be a discharge of pollutants, the construction of which commenced after the publication of the proposed Pretreatment Standards under Section 307 of the Act which will be applicable to such source if such Standards are thereafter promulgated in accordance with that section, provided the building facility or installation is constructed at a site at which no other source is located, or totally replaces the process or production equipment that causes the discharge of pollutants at the existing source, or the production or wastewater generating processes of the location are substantially independent of an existing source at the same site. In determining whether these are substantially independent, factors such as the extent to which the new facility is integrated with the existing plant, and the extent to which the new facility is engaged in the same general type of activity at the existing source should be considered.
   (32)   "Non-cooking establishments” means those establishments primarily engaged in the preparation of precooked food products that do not include any form of cooking, but that may produce a consumable food product in or on a receptacle requiring washing for reuse.
   (33)   "Normal sewage" means sewage or waste, which when analyzed, shows by weight a daily average of not more than 2000 pounds (240 parts per million) of suspended solids and not more than 1667 pounds (200 parts per million) of B.O.D.
   (34)   "0 and M" means operation and maintenance.
   (35)   "OAC" means Ohio Administrative Code.
   (36)   "On-site Grease Interceptor Treatment" means mechanisms or procedures utilized by a user to treat grease interceptor content on the user's site farrowed by the reintroduction of such treated wastewater back into the interceptor. A user may only initiate on-site grease interceptor treatment if the user or the user's contracted service provider is permitted by the Ross County Department of Environmental Health, and the City of Chillicothe, Ohio.
   (37)   "Other Wastes" means decayed wood, saw dust, shavings, bark, lime, refuse, ashes, garbage, offal, tar, chemicals and all other substances except sewage and industrial wastes.
   (38)   "Pass through" means a discharge which exits the POTW which alone or in conjunction with other discharges causes the POTW to be violation of its NPDES permit.
   (39)   "Permit" means a document issued by the Authority authorizing the User or his contracted service provider to treat or dispose of contents of the User's grease interceptor.
   (40)   "pH" means the logarithm of the reciprocal of the weight of hydrogen in grams per liter of solution.
   (41)   "Pollutant" means any substance discharged into a POTW or its collection system listed in Appendices A and B hereto, or any substance which upon exposure to or assimilation into any organism will cause adverse effects such as cancer, genetic mutations or physiological manifestations as defined in standards issued pursuant to Section 307(a) of the Act.
   (42)   "POTW" means any sewage treatment works and the sewers and conveyance appurtenances discharging thereto, owned and operated by the City.
   (43)   "Pretreatment" means the reduction of the amount of pollutants, the elimination of pollutants, or the alteration of the nature of pollutant properties in wastewater to a less harmful state prior or in lieu of discharging or otherwise introducing such pollutants into a POTW.
   (44)   "Private sewer" means a sanitary sewer which is not owned by the City but which is connected to the sanitary sewer system and, therefore, under the control of the City.
   (45)   "Properly shredded garbage" means the wastes from the preparation, cooking and dispensing of food that has been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers.
   (46)   "Public sewer'' means a sewer which is owned and controlled by the City.
   (47)   "Sanitary Sewage" or "Sewage" means any water carried human wastes or byproducts, or a combination of water carried wastes from residences, business buildings, institutions and/or industrial establishments, together with any other waters as may be present.
   (48)   "Sanitary Sewer" or "Sewer" means any pipe, conduit, or other device used to collect and transport sanitary sewage and industrial wastes from the generating source and to which storm, surface and ground waters are not intentionally admitted.
   (49)   "Service Provider" means any third party not in the employment of the User that performs maintenance, repairs and other services on a User’s grease interceptor for one or more independent establishments.
   (50)   "Sewage works" means all facilities for collecting, pumping and disposing of sanitary sewage and other wastes at a treatment plant owned and operated by the City.
   (51)   "Shall" is mandatory.
   (52)   "Significant Industrial User" or “Major Significant Industrial User” means:
      A.   Any industrial user subject to Categorical Pretreatment Standards; or
      B.   Any industrial user that discharges an average of 25,000 gpd or more of process wastewater to the POTW (excluding sanitary, noncontact cooling and boiler blow down wastewater); or
      C.   Any industrial user that contributes a process waste stream which makes up five percent (5%) or more of the average dry weather hydraulic or organic capacity of the POTW treatment plant; or
      D.   Any industrial user that is designated such by the City on the basis that the industrial user has a reasonable potential for adversely affecting the POTW's operation or for violating any pretreatment standards or requirements.
Upon finding that an industrial user meeting the criteria in this subsection has no reasonable potential for adversely affecting the POTW's operation or for violating any pretreatment standard or requirement, the City may at any time on its own initiative or in response to a petition received from the industrial user, determine that such industrial user is not a Major Significant User.
   (53)   "Slug load" means any pollutant, including oxygen demanding pollutants (BOD, etc.) released in a single extraordinary discharge episode of such volume or strength as to cause interference to the POTW.
   (54)   "Suspended solids" mean the solids that either float on the surface of, or are in suspension in water, sewage or other liquids, and which are removable by laboratory filtering.
   (55)   "Toxic pollutants" means those substances listed in 40 CFR 401.15.
   (56)   "Upset" means an exceptional incident in which a discharger unintentionally, and temporarily, is in a state of noncompliance with the standards set forth in this chapter due to factors beyond the reasonable control of the discharger, and excluding noncompliance to the extent caused by operational error, improperly designed treatment facilities, inadequate treatment facilities, lack of preventive maintenance, or careless or improper operation thereof.
   (57)   "User" means a property owner who provides common interceptors for one or more independent establishments.
   (58)   “Wastewater" means industrial waste, sewage, or any other waste that may be combined with water that may be discharged to the POTW.
   (59)   "Wastewater treatment plant” means any arrangement of devices or structures used for treating sewage.
