315.05 ENFORCEMENT.
   (a)   In any civil proceeding for the enforcement of any traffic law violation, the alleged violator is entitled to the benefits of the procedures set forth in the Ohio Rules of Civil Procedure, in Title 23 of the Ohio Revised Code, and in the Ohio Rules of Evidence.
   (b)   In any administrative proceeding for the enforcement of any traffic law violation, the alleged violator is entitled to the benefits of the procedures set forth in Title 119 of the Ohio Revised Code and in the Ohio Rules of Evidence.
   (c)   Notwithstanding the provisions of subsections (a) and (b) hereof, alleged traffic violators in any civil or administrative traffic proceeding are also entitled to the benefits of such other sections of state, federal, or common law as may apply.
