913.02 SERVICE CHARGE AND SURCHARGE.
   A sewage service charge and a sewer service surcharge is hereby established:
   (a)   For any lot, parcel of land, building or premises situated within or without the City and having any connection with the City sanitary sewerage system or otherwise discharging sewerage, liquid wastes, water or other liquids, either directly or indirectly, into the City sewerage system, and which lot, parcel of land, building or premises receives all of the water used in or on such lot, parcel of land, building or premises from the Division of Water, such sewerage charges or rentals shall be based upon the quantity of water used thereon or therein and shall be in an amount equal to the charge per 100 cubic feet based on water meter readings for the water used or metered to the lot, parcel of land, building or premises, with a minimum sewer service charge and shall be established as set forth in Ordinance 23-00 and shall be posted and made available to the public at the Utilities Department located at 35 South Paint Street, Chillicothe, Ohio. The Utilities Department shall provide a copy of said rates upon request by any person at cost.
   (b)    In the event a lot, parcel of land, building or premises, discharging sewerage, liquid waste, water or other liquids into the City sewerage system, either directly or indirectly, does not receive all of the water used in or on such lot, parcel of land, building or premises from the Division of Water, and all of the water used thereon or therein is not measured by a City water meter, or a meter acceptable to the Director of Utilities, then, in each such case, the amount of water used which is not so metered shall be otherwise measured or determined by the Director in order to determine the sewer service or rental charge, and as further set out below. When the total amount of water used thereon or therein is determined by the Director, such sewerage service charge or rental shall be an amount equal to the charge per 100 cubic feet in sewer service charges based on water readings as set out in the schedule in subsection (a) hereof that would have been charged by the Division of Water under the schedule of rates applicable thereto, had all the water so determined to have been used thereon or therein been furnished by the Division of Water.

   (c)    In cases falling, within the classification mentioned in subsection (b) hereof, where the Director finds it impractical to attempt to measure the water used in or on the lot, parcel of land, building or premises in question by meter, he may determine the amount of water so used for the purpose of calculating the sewer service charge or rental by such method as he may find practicable in light of the conditions and attendant circumstances of the particular use.
   (d)    In all cases where the premises involved uses water purchased from the City, which is metered separately and which is not discharged into the sanitary sewer system of the City or which uses water provided by privately owned wells and which is not discharged into the sanitary sewer system then, in such cases, the rates levied by this section shall not apply to such water. If a portion of the metered or unmetered water is discharged to the sanitary sewer the Director may determine the amount of water so used for the purpose of calculating the sewer service charge or rental by such method as he may find practicable in the light of the conditions and attendant circumstances of the particular case.
   (e)    In every case when an existing or proposed user desires to discharge to the City's sewerage system a waste of greater than the hereinafter defined strength of normal sewage, the City shall determine:
      (1)    To refuse to accept the waste for treatment; or
      (2)    Require pretreatment by the user to a strength of normal sewage; or
      (3)    To accept and treat the waste for the following stated surcharge.
   No provision of this section shall prohibit any special agreements with users, as may be determined to be desirable by the City, for purposes such as equalizing of flow, time of waste treatment, accepting special wastes, etc. All such special agreements shall be governed by the provisions and rates as set forth in this section.
   (f)    A sewer service surcharge shall be applied when either or both the total suspended solids and B.O.D. of a water or waste accepted for admission to the City sewage works exceeds the values of these constituents for normal sewage. The excess concentration in either or both, as the case may be, shall be evaluated volumetrically in terms of normal sewage and be subject to surcharge on the volume as derived in accordance with the following formula:

Bc = Unit cost for B.O.D. in dollars per lb of B.O.D.
B = Strength of B.O.D. in wastewater in excess of
Normal Domestic Strength Waste.
Sc = Unit cost for suspended solids in dollars per lb of
suspended solids.
S = Strength of suspended solids in wastewater in
excess of Normal Domestic Strength Waste.
Vu = Total Vol Discharge by user in 1000 of gals.
General Assumption Accepted by EPA:
