553.05 USE OF RIGHT OF WAY FOR HOUSING PURPOSES.
   (a)   No railroad company shall knowingly permit any railroad right of way within the City under its control or ownership to be used for temporary or permanent housing facilities for workmen on the railroad or for any other agent or employee of such railroad company.
   (b)    This section does not apply to passenger trains carrying fare paying passengers coming to rest in the City and remaining at rest for a period of less than twelve hours.
   (c)    Upon the filing of an affidavit or complaint for violation of this section, summons shall be issued to the railroad company pursuant to Ohio R. C. 2935.10(B) which summons shall be served on the regular ticket or freight agent of the company in Ross County, Ohio, or in the county closest to Ross County if no such agent is located in Ross County.
   (d)    Violation of this section is a misdemeanor of the third degree.
