(a) No person shall knowingly place or permit to be placed a refuse or trash receptacle of ninety-gallon capacity or larger within sixty feet of a City street for more than twenty-four hours in any seven-day period in a residential district.
(b) It shall be an affirmative defense to a charge under subsection (a) hereof when all of the following apply:
(1) The refuse or trash receptacle is for a lawfully conducted business, professional or commercial activity. The rental of housing units is not a business, professional or commercial activity as used in this section; and
(2) It is physically impossible to place such ninety-gallon capacity or larger refuse or trash receptacle more than sixty feet from any City street within the confines of the owner's or occupant's property.
(c) A violation of this section is a minor misdemeanor.
