(a) Application for a bicycle license shall be made to the Police Department or to a retail bicycle dealer appointed by the Mayor as a deputy registrar by letter, upon a form to be provided by the City Auditor who shall establish procedures for its completion and filing, and accounting of the fees collected. The application shall be accompanied by a fee of one dollar and twenty-five cents ($1.25) to be paid in advance of the time of issuance of the license. The license shall be effective for a period co-extensive with the existence of the bicycle, but may be transferred when the ownership of the bicycle is transferred. Every transfer shall be registered with the Police Department or a retail bicycle dealer upon forms provided by the Auditor, for a transfer fee of twenty-five cents ($0.25). Upon receipt of the application in proper form, the Chief of Police shall provide, at the expense of the City, a proper tag or decal which the applicant shall cause to be attached to the frame of the bicycle in a substantial manner. The removal of any such tag or decal except by proper authority of the Police Department, shall be a violation of this chapter. The retail bicycle dealer deputy registrar shall be paid twenty-five cents ($0.25) for any application or transfer of bicycle licenses.

(b) Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
